@Steve63, so IF your car fails its mot, can the owner still drive it DIRECTLY home or TO a test station TO BE TESTED PROVIDED ITS PREVIOUSLY BOOKED IN FOR A TEST? or has this changed please?

police in derby have no discresion i have i hate to say it a friend in traffic and until recently i was in recovery so please don't give derby traffic lads grief send a nice polite rocket up the chief constables ass since he has come in derby traffic has suffered due to his very wierd and wondrfull ! idea's and his love of speed cameras and dirty tactic's also i still belive as long as it is booked in and not been completly condemd i dont no the form number but as long as it is a normal fail your ok

typical example - if cops are staying and catching drivers and if near will be accident, they will not go there, where is accident but they will continue what they are doing

and many others. Of course, I only read about it in forums and in news because I live enough far away from our capital.


P.S. Gaz isn't that enough? It's even more serious than damaged exhaust and cop said it's exhaust because he didn't believe it's such stupid damage, I wouldn't beleve as well

Assuming the car still has an MOT and it fails then you can drive it until the MOT runs out (assuming its not in a dangerous condition)

If the car has NO MOT (i.e the MOT has lapsed) then you can drive it to a pre-booked MOT and if it fails then you can drive it straight to a place of repair or straight back home, I think you can drive it straight to a scrapyard if you wish too (i.e you own a Ford).

Steve, I was told by a recovery contractor that the insurance database is updated every Thursdsay, their yard was full of cars that had been unlawfully/illegally/wrongly seized by the police for having no insurance. If the police are proved wrong they are suppost to pay the recovery and storage charges but most of the time they refuse. The innocent owner has to pay to get their car back, or ultimately it gets crushed. Its a bit of a scandal IMHO.

No insurance isnt a six month ban. Its six points. If you already have six or more then u MAY be walking for a bit.

The magistrates have the power NOT to ban you in circumstances of hardship, ie, you need your car for a lengthy trip to work, family to support etc, hospital appointments.

I regularly deal with people who have 13, 14 points and still have their licence. It is a loophole that should be for the people who really need it but sometimes it gets used and abused a bit. But, I suppose, thats down to switched on defence solicitors really I guess, acting in the best interests of their clients.

Rich, the MOT exemption is correct as you stated, had to use that many times in the past!!
BUT....If you are driving back for example with defective brakes, say its failed due to brakes too low on efficiency, and you are aware, clearly you would be, then on your way back you have a bump and one of us Bolt Necks arrives and its found that your brake fault was a contributory factor in the collision, even if you are not the cause of the collision, then you are looking down the wrong end of a Section 1 Dangerous Driving charge, because of the defective brake condition of the vehicle, which you are aware of, as its just failed its MOT.

The defence to that would be that you were not aware of the condition of the brakes and had no reason to believe they were defective, and you would have to covince a jury.....So the idea would be to have the smash on the way TO the MOT station!!!!!

I was only going for its test Guv

still MOT'ed until the 21st May but going in this weekend for a test next Tuesday.... wasnt planning on crashing into ANYTHING/ANYONE ma Lord

If the brakes were THAT bad
a) you would know that already
b) I wouldnt be driving a car which wasnt road worthy in the first place.... no doubt you see many folk who do
