I apologise up front for my language regarding the subject of the following post.
This is a heads up for anyone receiving post from overseas and the aforementioned company know as parcelforce. For sometime now, these greedy shits have been acting outside of the law of this land by applying a "clearance "fee of some £8 or £13.50 on parcels. The illegality comes in because theyre applying a Lien ( a lien is a form of security granted over an item of property to secure the payment of a debt or performance of some other obligation) and delaying your parcels with the threat of returning them to sender if you dont pay up and bend over. The relevant law is here: According to section 105, 104, 83 and 84 of the Postal Services Act 2000: http://www.opsi.gov.uk/acts/acts2000/00026--h.htm It states there must be no intentional delay of your postal packet. HM C&E can obviously delay it to check contents and apply duty but after that the mail must be delivered promptly. Parcelforce are breaking criminal law in sections 83 and 84 which state: Interfering with the mail: postal operators (1) A person who is engaged in the business of a postal operator commits an offence if, contrary to his duty and without reasonable excuse, he— (a) intentionally delays or opens a postal packet in the course of its transmission by post, or (b) intentionally opens a mail-bag. They are also breaking criminal law under section 104 which states: Inviolability of mails (2) Anything to which this subsection applies shall have the same immunity from— (a) examination, or seizure or detention, under a relevant power conferred by virtue of this Act or any other enactment, (b) seizure under distress or in execution, (c) in Scotland, any diligence, and (d) retention by virtue of a lien, Now we are NOT talking about duty/vat or customs charges which MUST be paid. No we are talking about parcelforces "clearance fee" which they inform you of by letter and threaten to return your item to sender. Some people have been irate about this rip off con artist company charging people for jumping in and paying the customs charges for you but giving you no option to do it yourself, they pile on their fee to cover their "costs" supposedly incurred whilst collecting the duty. But the problem is theyre acting in breach of the law by delaying post and applying that Lien. They can levy a fee AFTER its been delivered NOT before. Dont put up with it, tell as many people as you can and get these bastards stopped. They have paid up when confronted to prevent a precedent in law being established so the scam is continued. Someone with a better law degree than i dont have, might wish to start a class action- these turds have been ripping folk off for years. Time to stop them. Am i pissed off? Yes.
